The issue in Judge Walker’s ruling against Proposition 8 is simple: he rejects religion and traditional morality because they critique his own personal lifestyle. This seems clear in the “findings of fact” he made against religious teaching in his decision. For example,
Walker’s written decision listed as its 77th finding of fact: “Religious beliefs that gay and lesbian relationships are sinful or inferior to heterosexual relationships harm gays and lesbians.”
Personally, I see the inferiority of homosexual relationships to be self-evident. They can’t produce life. That’s apart from a consideration of their morality.
